TERMS OF SERVICE

1. GENERAL INFORMATION

These Terms of Service govern the sale of products on modomikids.com and modomi.it, owned and operated by Modomi x Gavari di Hopfgartner Gerda, Via Giovanni Sercambi 37, 50133 Firenze, Italy, VAT no. IT06965990481.

By accessing our website and/or purchasing from us, you agree to be bound by these Terms of Service, including all referenced policies. If you do not agree to these terms, you may not use our services.


2. ORDERING

2.1. Availability

Our online store is available 24/7; however, occasional maintenance may lead to temporary unavailability.

2.2. Order Eligibility

  • Customers must be 18 years or older with a valid payment method.

  • If under 18, an adult must place the order.

  • Products are for personal use only and may not be resold for business purposes.

2.3. How to Place an Order

  1. Select a product, choose the size, and click "ADD TO CART".

  2. Review your cart and proceed to "CHECKOUT".

  3. Enter your shipping details or log into your customer account.

  4. Confirm your shipping method and proceed to "PAYMENT".

  5. After entering payment details and clicking "COMPLETE ORDER", your order becomes binding.

  6. Once accepted, payment authorization will be obtained, and you will receive an order confirmation email.

 

3. PAYMENT & TAXES

3.1. Secure Payment

We accept multiple payment methods, including:
- Visa, MasterCard, American Express
- PayPal, Apple Pay, Google Pay

Your card will be charged once your order is shipped.

3.2. VAT & Import Duties

  • Prices are displayed excluding VAT, as we operate under the regime forfettario.

  • Depending on your location, customs duties or taxes may apply, payable upon delivery.

  • Refusal to pay these charges will result in order cancellation, with shipping and customs costs deducted from any refund.

4. ORDER CANCELLATION & RETURNS

4.1. Cancellation Before Shipping

  • You may cancel your order before the fulfillment process begins, provided no shipment label has been created.

  • To cancel, email studio@modomikids.com.

  • The full amount will be refunded immediately.

4.2. Cancellation After Shipping

  • Once a shipping label is created or the order is dispatched, cancellation is not possible.

  • However, you may return the parcel once delivered.

  • Return shipping costs are at the customer’s expense.

4.3. Return Policy

  • Returns are accepted within 30 days of receiving the item(s).

  • If multiple items are delivered separately, the period starts upon receipt of the final item.

  • To request a return, email studio@modomikids.com.

Note: Simply refusing the parcel without prior notice does not count as a valid return request.

 

5. AUTOMATIC ORDER RETURNS

5.1. Unclaimed Parcels at Access Points

  • If the courier cannot deliver to the provided address, your parcel will be redirected to an Access Point.

  • You will receive an email notification with details on how and when to collect it.

  • If unclaimed within three (3) days (or the courier’s deadline), the parcel will be automatically returned to us.

5.2. Refunds for Unclaimed Parcels

  • If your parcel is returned due to non-collection, a refund will be issued minus shipping costs (both original and return shipping fees).

  • If you wish to have the parcel re-shipped, email studio@modomikids.com. Additional shipping charges will apply.

 

6. COMPLAINTS & WARRANTY

6.1. Right to File a Complaint

  • If your product has a defect, you may file a complaint within 24 months under Italian consumer protection laws.

  • To submit a claim, email studio@modomikids.com with:

    - Order number

    - Photo(s) of the issue

    - Description of the defect

If the claim is valid, we will repair, replace, or refund the product.

Note: If justified, Modomi Kids will cover reasonable return shipping costs.

 

7. PERSONAL DATA POLICY

  • We collect name, address, phone number, and email for order processing and delivery.

  • Your data is stored securely for five (5) years before deletion.

  • We never sell or share data with third parties outside the EU or GDPR-compliant countries.

8. LIABILITY & CONTENT DISCLAIMER

  • While we strive for accurate product descriptions and pricing, occasional errors (price changes, sold-out items) may occur.

  • We reserve the right to cancel or modify orders in such cases.

  • Modomi Kids is only liable as per Italian law.

 

9. STANDARD CANCELLATION FORM

10. CHANGES TO TERMS OF SERVICE

These terms may be updated occasionally. The latest version will always be available on our website. Continued use of the site constitutes acceptance of any updates.
